eustella API Platform Terms

Last updated: 12.10.2026 · Version 1.0.0

These API Platform Terms apply to your use of the eustella API Platform. The "API Platform" means the eustella services that give programmatic access to eustella models through API keys at platform.eustella.com, together with the API dashboard in which you manage your account, API keys, organisation and billing. The API Platform is a separate service from the Team and Enterprise plans for the eustella app (the "Business Plans"); you can use it on its own or together with a Business Plan, and these API Platform Terms do not apply to Business Plans. These API Platform Terms supplement and form part of our Business Terms, which are the master agreement between you and AI Newsrooms Technology GmbH ("eustella", "we", "us"). "You" or the "Customer" means the company, organisation or other business on whose behalf the API Platform is used.

Capitalised terms not defined here have the meanings given in the Business Terms and in our Terms of Use, in particular "Services", "Input", "Output" and "Content".

1. Scope and contract documents

How the documents fit together. Your use of the API Platform is governed by the Business Terms together with these API Platform Terms, the Usage Policy, the Service Terms — in particular their section on the API Platform — and the Data Processing Agreement. As regards the API Platform, these API Platform Terms prevail over the Business Terms in the event of a conflict. An individual written agreement and, as regards the processing of personal data, the Data Processing Agreement prevail over these API Platform Terms.

Businesses only. The API Platform is offered exclusively to businesses. By accepting these API Platform Terms, you confirm that you are acting in the course of your trade, business or profession and not as a consumer within the meaning of the Austrian Consumer Protection Act (KSchG) or Directive 2011/83/EU.

Acceptance. You accept these API Platform Terms together with the Business Terms, including the Data Processing Agreement, and the Usage Policy when you confirm your acceptance while creating an account or signing in to the API dashboard. The contract for the API Platform is concluded when your account is created.

2. Your account, organisation and API keys

Organisation. Each API Platform account is also an organisation. Its API Credit balance, saved payment card, API keys and usage belong to the account. The person who created the account is its owner. The owner always has full administrative rights and cannot be removed from the organisation.

Members and roles. You may invite other people to your organisation and assign each of them a role — such as admin, developer, billing or member — which determines what they may do in the API dashboard. You are responsible for the people you admit to your organisation, for the roles you assign to them, and for removing access that is no longer needed. When a member is removed, the API keys they created in your organisation are revoked. Everything done through your account, by any of its members or with any of its API keys, is attributed to you, and you are responsible for it as for your own conduct.

API keys. API keys are secret credentials. You are responsible for keeping them confidential and secure. You may not share them with anyone outside your organisation, embed them in software or web pages where others can read them, or buy, sell or otherwise transfer them. Revoke any API key you believe may have been compromised in the API dashboard without undue delay, and inform us at security@eustella.com if you suspect unauthorised use of your account.

Responsibility for usage. You are responsible for, and must pay for, all usage made through your account and with your API keys until the relevant key has been revoked or we have been informed of the unauthorised use, unless the unauthorised use was caused by our breach of the Business Terms or these API Platform Terms.

3. Your applications and end users

Customer Applications. You may use the API Platform to build and operate your own applications, products and services and make them available to your own users ("Customer Applications" and "End Users"). You are responsible for your Customer Applications, for your End Users' use of them, and for the terms on which you offer them.

Flow-down. You must ensure that the use of the Services through your Customer Applications complies with the Usage Policy, and you must take reasonable steps to prevent, detect and stop misuse by your End Users, including by suspending End Users who violate it. You may not give End Users access to your API keys.

AI Act obligations. Where you integrate the Services into an AI system of your own, or put Output into use, you may be a provider or a deployer of an AI system within the meaning of Regulation (EU) 2024/1689 (the "AI Act"). You are responsible for complying with the obligations that apply to you in that role, including in particular:

  • informing natural persons that they are interacting with an AI system, unless this is obvious from the circumstances (Article 50(1) AI Act);
  • where applicable, ensuring that synthetic audio, image, video or text content generated through your Customer Applications is marked as artificially generated in a machine-readable format (Article 50(2) AI Act);
  • disclosing deep fakes and AI-generated text published to inform the public on matters of public interest, as described in our Sharing & Publication Policy (Article 50(4) AI Act); and
  • taking measures to ensure a sufficient level of AI literacy among your staff and other persons who operate AI systems on your behalf (Article 4 AI Act).

No high-risk use without agreement. The Services are not designed, assessed or offered for use as, or as a safety component of, a high-risk AI system within the meaning of Article 6 AI Act, and may never be used for a practice prohibited under Article 5 AI Act. If you intend to use the Services in a high-risk AI system, you require our prior written agreement, and you remain solely responsible for the obligations that apply to that system.

Your other legal obligations. You are responsible for complying with all laws that apply to your Customer Applications, including data protection, consumer protection, platform and professional regulation. Where you process personal data of End Users or other persons through the Services, you act as controller (or as processor for your own customer), and the Data Processing Agreement applies.

4. Prepaid API Credit, prices and payment

Prepaid API Credit. Use of the API Platform is paid for in advance. You purchase credit denominated in euros ("API Credit"), and the price of each request is deducted from your API Credit balance when the request has been processed. Before a request is processed, we reserve an estimated amount of API Credit, which is released once the actual price has been charged. A request is refused if your balance does not cover the reserved amount.

Prices. The price of each model is stated in euros per billing unit — for example per million input or output tokens, per minute of audio, or per page — and is shown in the API dashboard and in the model list returned by the API. Prices are net prices exclusive of value added tax (VAT) and other applicable taxes.

Negative balance. Because the actual price of a request can only be determined once it has been processed, the price of an individual request may exceed your remaining balance, and your balance may become negative. A negative balance is owed to us and is settled against your next purchase of API Credit.

Purchasing API Credit. You purchase API Credit in the API dashboard, by payment card, through the checkout of our payment service provider. The minimum and maximum amount of a single purchase are shown in the API dashboard. Your balance is credited with the net amount you purchase once the payment has been confirmed.

Taxes. Applicable VAT is added to the net amount of each purchase. It is calculated on the basis of the billing address and, where you provide one, the VAT identification number you submit at checkout. Where the reverse-charge mechanism applies, VAT is accounted for by you. You are responsible for the accuracy of the billing and tax information you provide, and for any taxes and duties owed by you under the law of your country.

Invoices. We issue an invoice for each purchase of API Credit. Invoices and payment receipts are available in the payment history of the API dashboard. You agree to receive invoices in electronic form.

Automatic top-up. You may save a payment card in the API dashboard and switch on automatic top-up, for which you choose a balance threshold, a top-up amount and a monthly cap. By switching on automatic top-up, you authorise us, through our payment service provider, to charge your saved payment card with the top-up amount plus applicable VAT, without any further action on your part, each time your API Credit balance falls below the threshold, provided that the total of the automatic top-ups in a calendar month (UTC) does not exceed your monthly cap. This authorisation covers payments we initiate while you are not present. You may change these settings, switch automatic top-up off, or remove your saved payment card at any time in the API dashboard; removing the card also switches automatic top-up off. Changes apply to charges initiated after they have been saved. If a charge is declined or requires your authentication, automatic top-up is paused until you save a card or confirm your settings again.

Promotional API Credit. We may grant API Credit free of charge, for example as sign-up API Credit, for a trial, or as a goodwill gesture ("Promotional API Credit"). Promotional API Credit has no cash value, is not refundable, and is subject to any conditions and period of validity we state when granting it. We may withdraw Promotional API Credit that has been obtained or used in breach of the Business Terms or these API Platform Terms, for example by creating multiple accounts.

Validity of API Credit. API Credit is valid for 12 months from the date of the purchase by which it was added to your balance, and expires at the end of that period to the extent it has not been used. API Credit is not a deposit, bears no interest, cannot be exchanged for cash, cannot be transferred to another account, and can be used only for the Services.

Refunds. API Credit is non-refundable, except where these API Platform Terms or the Business Terms expressly provide otherwise or where a refund is required by law. If we terminate the contract without cause, or because we discontinue the API Platform, or if you terminate it because you do not agree to a material change to the Business Terms or to these API Platform Terms, we will refund the unused balance of the API Credit you purchased. Promotional API Credit is not refunded.

Billing objections and failed payments. If you believe a charge or an invoice is incorrect, please inform us at support@eustella.com within 60 days of the charge, stating the reasons for your objection. If a payment is reversed or charged back without justified reason, we may suspend your account until the amount owed has been settled.

Price changes. We may change our prices. We will inform you of any price increase in the API dashboard under platform.eustella.com. A price increase applies only to requests made after it has taken effect; the euro value of your existing API Credit is not affected. Price reductions, and prices for new models or features, may take effect immediately. If you do not agree to a price increase, you may stop using the affected model or terminate the contract before the increase takes effect.

5. Usage limits and fair use

Rate and concurrency limits. Each API key is subject to limits on the number of requests per second and on the number of requests it may have in progress at the same time, and each account may hold a limited number of API keys. The limits that currently apply to your account are shown in the API dashboard and described in the Service Terms. We may adjust limits, generally or for individual accounts, where this is reasonably necessary to protect the stability, security or fair availability of the Services. You may ask us to raise a limit for your account.

No circumvention. You may not circumvent or attempt to circumvent usage limits, spending controls or restrictions — for example by using multiple accounts or API keys, or by distributing requests in a way designed to avoid a limit.

6. Retention of Content

We process API Input only to generate the response to the request. Input and Output are held only in working memory while a request is processed — including in short-lived caches that speed up the processing of repeated Input — and are not written to persistent storage or kept in a request history. No moderation records are kept for API requests either: content moderation records exist only for the eustella app, and the results of the moderation endpoint are returned to you without being stored. For each request, we retain a usage record — the model, the API key, the billing units, the price and the time of the request, but not its Content — to operate your account, to bill you, and to comply with our retention obligations under Austrian law. Our systems also keep technical logs of request metadata, such as the time, the endpoint, the status and the duration of a request, for security and operational purposes; these logs do not contain the text, audio, images or documents you send, or the Output.

7. End of the contract

When the contract ends, your API keys are revoked and your access to the API Platform ends. Unused API Credit expires, except where it is refunded under Section 4. Amounts owed to us remain payable. Sections 4 (as regards amounts owed and refunds) and 6 survive the end of the contract. Suspension and termination are otherwise governed by the Business Terms.

8. Changes to these API Platform Terms

We may update these API Platform Terms on the same terms as the Business Terms: we will give you at least 30 days' advance notice of any material change by email or in the API dashboard, and if you do not agree to it, you may terminate the contract before it takes effect. Changes required by law, or that concern only new features, may take effect immediately.
