These Service Terms govern your use of specific eustella features and Services. Capitalised terms not defined here have the meanings given in the eustella Terms of Use ("Agreement"). If there is a conflict between these Service Terms and the Agreement, these Service Terms will control.

1. Beta Services

This section governs your use of eustella services or features that are offered on a closed beta, open beta, early access, preview, or pilot basis ("Beta Services").

Nature of Beta Services. Beta Services are provided to allow testing and evaluation prior to general availability. They may contain bugs, errors, or inaccuracies, and may not function as intended. Features available during the beta may change, be reduced, or be removed entirely before or at general availability. By participating in a Beta Service, you acknowledge that frequent and significant changes are an inherent feature of beta participation.

No fees during beta. Beta Services are provided to you free of charge. We will not charge you any fees during the beta period. If we decide to introduce paid features or paid tiers during the beta, we will notify you in advance and your continued use of any paid feature will be subject to the "Paid accounts" section of the Terms of Use, including the 14-day withdrawal right and the modification rules in the "Changes to these Services" section of the Terms of Use.

No warranties. Beta Services are offered "as-is" and "as-available." To the extent permitted by applicable law, eustella makes no representations or warranties for Beta Services, including any warranty that Beta Services will be generally available, uninterrupted, or error-free, or that Content will be secure or not lost or damaged. Except to the extent prohibited by law, eustella expressly disclaims all warranties for Beta Services, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. Nothing in this section limits or excludes your non-waivable statutory rights as a consumer under EU law, including any rights you may have under Directive (EU) 2019/770 on digital content and digital services.

Feedback and improvements. We may invite you to provide feedback on Beta Services. You agree that we may use such feedback to improve, develop, and refine our Services without compensation to you. Providing feedback is voluntary.

Data during beta. Content you create or provide during the beta period will be handled in accordance with our Privacy Policy. We will make reasonable efforts to preserve your Content, but Beta Services may involve data loss, resets, or migration as part of development. We will give you reasonable advance notice on a durable medium (for example, by email) before any planned reset, migration, or other change that we expect to result in loss of, or material reduced access to, your Content, so that you have an opportunity to export it. We will not use your Content to train AI models during or after the beta, consistent with our general Terms of Use.

Modifications and discontinuation of Beta Services. Because Beta Services are experimental and provided free of charge, we may modify, suspend, or discontinue any Beta Service at any time. Where a modification or discontinuation will materially adversely affect your use of a Beta Service, we will give you reasonable advance notice on a durable medium where this is practicable and not contrary to a legitimate operational, security, or legal reason. You may stop using any Beta Service and close your account at any time.

Transition to general availability. When eustella transitions from beta to general availability, your account and Content will carry over unless we notify you otherwise. Any terms that change at general availability — including the introduction of paid subscription terms — will be communicated to you at least 30 days in advance, and you will have the opportunity to accept or decline the updated terms before they take effect.

2. Image Capabilities

eustella may accept images as part of Input ("Image Capabilities"). The following rules apply when you use Image Capabilities:

Prohibited uses. You may not use Image Capabilities to attempt to identify a person, to solicit or infer private or sensitive information about a person from their image, or to reproduce the likeness of any person without their express consent and all necessary rights.

Your responsibility. You are responsible for ensuring that any image you provide as Input does not violate the rights of any third party, including intellectual property rights, personality rights, and data protection rights under the GDPR. You represent and warrant that you have the necessary rights and permissions for any image you upload.

AI-generated images. If eustella may generate images as part of Output, the ownership and usage rules set out in the "Content" section of the Terms of Use apply. You should not represent AI-generated images as photographs or as depicting real events unless clearly disclosed.

3. Connected Services

eustella allows you to connect third-party applications and services to your account, such as calendars, cloud storage, email, and other productivity tools ("Connected Services").

Authorisation. When you connect a third-party service, you authorise eustella to access and interact with that service on your behalf, within the scope of the permissions you grant. You can review and revoke these permissions at any time in your account settings.

Your responsibility. You are responsible for ensuring that your use of Connected Services through eustella complies with the terms and conditions of the relevant third-party service. eustella is not a party to your agreement with any third-party service provider.

Data from Connected Services. Data retrieved from Connected Services may be included in the Input or Output of eustella. We process this data solely to provide the Services to you and in accordance with our Privacy Policy. We do not use data from your Connected Services to train AI models.

Third-party terms. Connected Services are provided and operated by third parties. eustella does not control and is not responsible for the content, functionality, security, or availability of any Connected Service. If a Connected Service becomes unavailable, changes its terms, or restricts access, eustella's ability to interact with that service may be affected.

Security. Do not connect a third-party service unless you trust it and have reviewed its terms and privacy policy. If you believe a Connected Service has been compromised or is being accessed without your authorisation, disconnect it immediately and contact us at security@eustella.com.

4. Agentic Capabilities

eustella can perform tasks and take actions on your behalf, including interacting with Connected Services, drafting and sending communications, modifying files, scheduling events, and — in the future — performing transactions such as making purchases or bookings ("Agentic Capabilities").

You remain in control. Agentic Capabilities act on your instructions and within the permissions you grant. You can configure the level of autonomy the agent has in your account settings. eustella will seek your explicit confirmation before performing actions that are irreversible, financially consequential, or that affect other people, unless you have explicitly configured otherwise.

Your responsibility. You are responsible for all actions eustella takes on your behalf. Review the agent's proposed actions before confirming them. eustella does not guarantee that agentic actions will be error-free, timely, or produce the intended result. You should verify outcomes, particularly for actions with legal, financial, or interpersonal consequences.

Limitations. Agentic Capabilities depend on the availability and functionality of Connected Services and external systems. eustella cannot guarantee that a third-party service will accept, process, or complete any action initiated by the agent.

5. Regulated Professional Activities

eustella is an AI assistant. It is not a licensed professional and does not replace the judgment of qualified human professionals. The following restrictions apply:

Legal services. eustella does not provide legal advice. You may not use eustella to provide tailored legal counsel, prepare legal submissions, represent parties before courts or authorities, or offer legal opinions to third parties in a professional capacity. In Austria, the unauthorised provision of legal services (Winkelschreiberei) is prohibited by law. Similar prohibitions exist across the EU. eustella may provide general legal information for educational purposes, but this does not constitute legal advice and must not be relied upon as such.

Medical and health services. eustella is not intended for use in the diagnosis, treatment, or management of any health condition. You may not use eustella as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

Financial and tax services. eustella does not provide personalised financial, investment, or tax advice. You may not use eustella to provide regulated financial services or tax advisory services to third parties without the involvement of a licensed professional.

Other regulated professions. More broadly, you may not use eustella to provide tailored professional advice in any field where such advice requires a licence, registration, or professional qualification under applicable law — including but not limited to accounting, architecture, engineering, pharmacy, and psychotherapy — unless a licensed professional is appropriately involved in reviewing and approving the advice.

Disclosure. If you use eustella to assist you in a professional context (for example, to draft a document or research a topic), you remain responsible for the accuracy and appropriateness of the final output, and for complying with any professional or regulatory obligations that apply to you.

6. Content Generated by eustella

No guarantee of accuracy. Output generated by eustella may be incomplete, inaccurate, or out of date. You must evaluate all Output for accuracy and appropriateness before relying on it, sharing it, or using it for any consequential purpose. Third-party content. Output may reference or include content from third-party sources. Such references do not imply endorsement by or affiliation with eustella.

Open-source and third-party licences. Where eustella generates code, that code may be similar to or derived from open-source or publicly available code. Such code may be subject to third-party licences, including open-source licences. You are responsible for reviewing and complying with any applicable licence terms.

7. Medical Use

eustella is not a medical device and is not intended for use in the diagnosis or treatment of any health condition. You are responsible for complying with all applicable laws — including Regulation (EU) 2017/745 on medical devices and any national implementing legislation — for any use of eustella in a medical or healthcare context. Do not use eustella to analyse medical images, diagnostic data, or clinical signals.

8. Changes to These Service Terms

We may update these Service Terms from time to time as we develop new features and Services. We will give you at least 30 days' advance notice of changes that materially adversely affect you. New Service Terms sections may be added when new features or Services are launched.
